1. Voluntary Participation; No Payment

I understand and agree that my participation in the podcast interview, including the submission of personal or business financial records and involvement in related discussions, is entirely voluntary and is provided by me without compensation, royalty or payment of any kind. I understand and agree that I may discontinue my participation at any time before the interview is completed. Following completion of the interview, the Data Sleuth Podcast®, Data Sleuth, LLC and Workman Forensics, LLC, and their affiliated and related entities (collectively “Workman”), may edit, publicly release, publish, distribute, make derivatives of, copies of, and otherwise commercially promote the recording, including any edited versions thereof, which may include my image, likeness, and voice, for use on web, print, social media and broadcast use, globally and in perpetuity, and which may include photos, videos, audio, analysis, and related content and materials, which may be created before, during or after the podcast interview and without notice, royalty, payment or compensation to me of any kind.  I understand and agree that Workman may edit and release such materials from the recording, as it determines, in its sole and complete discretion, and that I do not have the right to inspect, approve, review, or receive notice of any publication, release, edits, use, materials or content related to the recordings and content released by Workman.  Workman shall own all right, title and interest in and to the interview recordings, content, and material, including any copyright interest therein, and to all related and associated related materials and content created by or used by Workman in connection therewith. 

2. Complimentary Dashboard Demonstration

I understand that the Data Sleuth® Dashboard access is provided solely as a complimentary demonstration in exchange for my participation on the podcast. The demonstration is intended for informational and educational purposes only. No work product, expert opinions, reports, or deliverables will be provided to me. Any analysis, findings, or information presented are solely for purposes of the podcast recording and demonstration. 

3. Financial Information and Analysis

I agree that all information I provide to Workman for the podcast interview and dashboard demonstration will be true and correct to the best of my knowledge, information and belief and that I have the right to provide such information to Workman and to enter into this agreement. I shall retain ownership of any financial records I provide to Workman for the podcast interview; provided however, that Workman shall have an irrevocable, worldwide, royalty free license and right to use the financial records for the podcast interview in perpetuity.   I understand that The Data Sleuth® Dashboard may analyze financial information that I voluntarily provide and may identify transactions, patterns, or activities that warrant further review for potential fraud, errors, unusual activity, or financial risk. I acknowledge that any analysis performed is based solely on the information provided and is not intended to be a comprehensive examination of all relevant records or circumstances. Workman Forensics, LLC, Data Sleuth, LLC, and their professionals make no representation or warranty that all issues, irregularities, errors, fraud, risks, or other matters will be identified. Neither entity or personal shall be responsible for any errors, omissions, conclusions, or outcomes resulting from incomplete information, unavailable records, or information not submitted for analysis. 

4. No Financial, Legal, or Professional Advice

I acknowledge and agree that any findings, reports, alerts, recommendations, or observations presented in the Dashboard or discussed during the podcast are not financial, legal, accounting, tax, investment, or other professional advice. I understand that I am solely responsible for evaluating any information provided and for seeking advice from qualified professionals when appropriate. I acknowledge and agree that Workman is not, by virtue of this agreement, being engaged as experts or consultants for any litigation, current, past, or future.  I further acknowledge and agree that I will not receive any work product, deliverable, copy of, draft, or other content or materials, including audio video, text, written related to or associated with the podcast interview. 

5. No Guarantee of Fraud Detection

I acknowledge and agree that the analysis results presented via The Data Sleuth® Dashboard is a technology tool and does not guarantee the detection, prevention, or identification of fraudulent activity, identity theft, financial crimes, errors, or losses. The absence of alerts does not indicate that fraud or risks do not exist.  

6. Accuracy of Information

Workman expressly disclaims and hereby makes no representation or warranty, express or implied, regarding the accuracy, quality, recommendations, analysis and other statements or commentary made during or about the subject matter of the podcast interview or by or through the Data Sleuth® Dashboard.  The quality and accuracy of the analysis is not guaranteed to adhere to any particular standard, is intended solely for informational and entertainment use only, is not a professional opinion or recommendation of any kind, is not intended and should not be relied upon by you for any purpose and depends on the accuracy and completeness of the information I provide. I understand that incomplete, inaccurate, or outdated information may affect the quality and accuracy of the analysis provided during the podcast interview and demonstration of the Data Sleuth® Dashboard.  

7. Limitation of Liability

To the fullest extent permitted by law, Workman, its owners, hosts, employees, affiliates, contractors, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or other damages, losses, claims, costs, or expenses arising from or related to my use of the Data Sleuth® Dashboard, reliance on the Data Sleuth® Dashboard findings, or participation in the podcast and any recording or distribution of content or materials related thereto or any information or materials provided by me to Workman.  

8. Podcast Recording and Use of Likeness

I grant Workman permission to record, edit, reproduce, distribute, publish, and commercially promote my interview, voice, name, likeness, and related content in any media format now known or later developed, without payment or royalty and without prior approval, consent or notice from me, unless otherwise agreed by separate mutual written agreement.  

9. Confidentiality and Personal Information

I understand that I should not disclose sensitive or confidential personal or business information during the podcast recording, including account numbers, Social Security numbers, passwords, security codes, or other confidential financial credentials. Any information voluntarily shared by me with Workman may become part of the public podcast record and may be used, distributed or published by Workman unless specifically removed by separate mutual written agreement.  

10. Release

I release and discharge Workman, and its representatives from any and all claims arising out of my participation in the podcast, the recording, use, editing of, and public display and commercial use of the recording, including but not limited to, claims arising from tort or contract, claims for payment or royalties, claims for defamation, copyright infringement, unauthorized use or disclosure of confidential information, invasion of privacy, right of publicity, claims related to any errors, omissions, or the accuracy or quality of any recommendations, analysis or commentary provided during the podcast interview, or my use of the complimentary Data Sleuth® Dashboard demonstration, except where prohibited by law. I agree to indemnify, defend, and hold harmless Workman, and its representatives, from any and all such claims by me, my heirs, estate, or assigns, and from any and all such claims from any third-party related to my use of the Data Sleuth® Dashboard, the podcast interview, the editing thereof, and the distribution and use of the recording, content and materials related thereto and associated therewith.   

11. Acknowledgment

By participating in The Data Sleuth® Podcast and accepting access to the complimentary Data Sleuth® Dashboard demonstration, I acknowledge that I am over the age of 18, have full capacity and authority to enter into this agreement, have read, understood, and voluntarily agree to the terms stated above.
